Yom Tov Sheni – Shu”t Minchas Asher

Question:
Hi,

I was reading through one of the fantastic Teshuvos regarding Melacha on Yom Tov Sheini (in Minchas Asher volume 1, Siman 11, part 3). The Teshuva specifically dealt with asking one who lives in Israel to do Melacha for one who lives in Chutza La’aretz on Yom Tov Sheini. At the end of the Teshuva you stated that in Igros Moshe Orach Chaim 3:71 Rav Moshe concludes that a “Yirai Shamaim” should avoid asking an Israeli to do Melacha for him on Yom Tov Sheini, in accordance with what is implied from the Magen Avraham on Shulchan Aruch, Orach Chaim, Siman 263. However, I believe that Rav Moshe slightly alters his opinion at the end of the Teshuva, and actually concludes that even “Ba’alei Nefesh” have no reason to be Machmir. I could have completely misunderstood what either you, or Rav Moshe, was saying, and apologize if I did.

Thanks so much,

Answer:

You understood correctly. The intent of the teshuva was that the Rav found precedent for what he was saying in the words of the Igros Moshe that the above issue may hinge on the machlokes Magen Avraham and Taz. The Igros Moshe himself goes on to be lenient for a different reason, which the Rav does not quote as he does not agree with that argument. In fact Igros Moshe himself just 2 teshuvos later in Siman 73 rules that one should be stringent in this matter, being that once he is keeping a second day of Yom Tov he must treat it as a full fledged Yom Tov.
